Internal Terms and Conditions for the ERNCEL AGENCIES Loan Management System — For Authorized Personnel Only
1. Purpose & Scope
These Terms & Conditions ("Terms") govern the use, access, administration, and management of the ERNCEL AGENCIES Loan Management System ("ERNCEL AGENCIES" or "the System"). ERNCEL AGENCIES is an internal application provided for authorized employees, contractors, and agents of the organization to manage loan lifecycle activities including origination, approval, disbursement, monitoring, and recovery.
These Terms apply to all individuals and systems that access or interact with ERNCEL AGENCIES, including but not limited to staff, administrators, developers, auditors, and third-party support personnel granted access by the organization.
2. Internal Use Only
ERNCEL AGENCIES is strictly for internal business purposes. Access, credentials, data, or functionality must not be shared with external parties unless explicitly authorized in writing by senior management and the Data Protection Officer (DPO). Any export, distribution, or disclosure of ERNCEL AGENCIES data outside the organization is prohibited unless performed in compliance with internal policies and any applicable laws.
3. Authorized Access & Account Management
- Access to ERNCEL AGENCIES is role-based and must follow the organization's access control procedures (least privilege principle).
- Users must authenticate using approved methods. Sharing of credentials is strictly forbidden.
- Administrators must promptly revoke access for terminated or role-changed users and document the change.
4. Data Handling & Privacy
ERNCEL AGENCIES contains personally identifiable information (PII) and sensitive financial data. Users must handle all data in accordance with the organization's Data Protection Policy and applicable privacy laws. This includes:
- Accessing only the data necessary to perform assigned duties.
- Never removing or transmitting sensitive data to personal devices without encryption and explicit authorization.
- Using organization-approved channels when exporting reports and redacting PII where required.
5. Confidentiality
All data, business processes, decision logic, reports, and analyses stored in or produced by ERNCEL AGENCIES are confidential. Users must not disclose this information outside the organization unless authorized. Confidentiality obligations persist after termination of employment or contract.
6. Acceptable & Prohibited Uses
Acceptable uses include activities required to perform job responsibilities such as:
- Processing loan applications, credit checks and approvals (per delegated authority).
- Generating internal reports and performing reconciliations for authorized teams.
- Performing audits and compliance activities with appropriate approvals.
Prohibited actions include, but are not limited to:
- Bypassing system controls, audit logs, or approval workflows.
- Using ERNCEL AGENCIES to process personal loans or business outside the organization.
- Reverse-engineering, scraping, or extracting confidential datasets for unauthorized use.
7. Audit, Logging & Monitoring
ERNCEL AGENCIES activity is logged and may be monitored to ensure security, compliance, and operational integrity. Authorized security, compliance, and audit teams may review logs and records. Tampering with or disabling logging mechanisms is strictly prohibited.
8. Security Responsibilities
- Users must follow organizational security guidance (passwords, multi-factor authentication, device management).
- Report suspected security incidents, suspicious activity, or data exposures immediately to the Security Incident Response Team.
- Apply secure coding and configuration standards for any integrations, scripts, or automation that interact with ERNCEL AGENCIES.
9. Integrations & Third Parties
Integrations (APIs, reporting extracts, or third-party services) must be approved by IT and Compliance before deployment. Third-party vendors connecting to ERNCEL AGENCIES must meet the organization's security and privacy requirements and be governed by appropriate contractual protections.
10. Intellectual Property
All software, documentation, templates, models, and configuration associated with ERNCEL AGENCIES are the intellectual property of the organization (unless otherwise stated). Users may not copy or repurpose IP for external distribution without written permission.
11. Liability & Disclaimers
The organization provides ERNCEL AGENCIES "as is" for internal use. While reasonable efforts are made to ensure accuracy and uptime, the organization disclaims liability for business losses arising from use of the System except where required by law. Users remain responsible for following internal procedures and making independent decisions consistent with their delegated authority.
12. Data Retention & Deletion
Data retention and deletion follow the organization's records retention schedule. Requests for data deletion or archival must be processed through the Data Governance team and logged. Users must not delete production data except via approved workflows.
13. Incident Response & Reporting
Any suspected data breach, unauthorized access, or security incident involving ERNCEL AGENCIES must be reported immediately to the Security Incident Response Team and the DPO. Users should preserve relevant evidence and follow incident response instructions.
14. Compliance & Training
Users must complete required training before gaining access and at regular intervals thereafter. Non-compliance with training or policies may lead to suspension of privileges.
15. Changes to These Terms
These Terms may be updated from time to time. Material changes will be communicated to authorized users. Continued use of ERNCEL AGENCIES after notice constitutes acceptance of the updated Terms.
16. Termination of Access
The organization reserves the right to suspend or terminate any user's access to ERNCEL AGENCIES for violation of these Terms, security concerns, or other business reasons. Upon termination, users must return or securely delete any local copies of confidential data in accordance with policy.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws and internal policies of the organization and the applicable jurisdiction. Any disputes arising from use of ERNCEL AGENCIES will follow the organization's dispute resolution procedures.
18. Acknowledgement & Acceptance
By accessing or using ERNCEL AGENCIES, you acknowledge that you have read, understood, and agreed to comply with these Terms and all related internal policies. Failure to comply may result in disciplinary action, up to and including termination of employment, and possible legal action.
